Biography

James has over 20 years’ experience in the Middle East Specifically.  He is considered an expert on Omani law, practice and procedure having spent 16 years in the country.  He has significant experience acting for multinational and Middle Eastern clients on a wide range of high-value and complex disputes, with particular expertise in construction arbitration and the Oman market.

James is experienced in agency/distributor/franchise matters (contentious (court cases and arbitrations) and non-contentious); construction disputes (court cases and arbitrations); debt recovery court cases for banks and others (including obtaining injunctive relief); high quantum tax court cases versus the Omani Government; ship arrests and other maritime cases; product liability advice and court cases; trademark infringement court cases; insurance court cases; disputes regarding factoring contracts; Administrative Court cases involving units of the Omani Government; enforcement actions in Oman; price variation disputes; mining disputes; general multi-million Omani Rial contractual disputes; brokerage disputes; labour law court cases; Administrative Court cases for and against units of Omani Government; directors’ liabilities litigation; criminal cases and margin trading litigation, together with advising corporate lawyers on drafting issues.

  • Acted for an Omani company in relation to a multi-million dollar claim for wrongful termination against a government owned entity. I undertook all advocacy myself.
  • Acted for Oman’s Ministry of Transport and Communications in relation to a long-standing dispute concerning the construction of roads by a Contractor. Matter was determined in accordance with Omani law and a 3 panel Tribunal.
  • Acted for Oman’s Ministry of Health in relation to its claim for damages arising from negligent design/supervision of a building project.
  • Acted for an Omani LLC in relation to a multi-million USD arbitration in agency dispute. Matter was determined in accordance with Omani law and a 3 panel Tribunal.
  • Acted for a part Omani government owned fuels marketing company in relation to issues pertaining to a throughput contract.
  • Acted for a high net worth Omani Individual Claimant on a RO 3m construction arbitration claim.
  • Acting for an Omani entity (Claimant) on an RO 7m construction arbitration claim.
  • Assisted a multinational entity in terms of strategy for defending arbitral claims made against it by its Omani contractual counter-party.
