Biography
Imad is an Associate in the Innovation & Patents practice, based out of KSA. He comes with a legal background and qualifications, and is a qualified lawyer in Lebanon.
Imad assists clients in relation to the protection, commercialization and enforcement of innovation, patents, and industrial property (3IP) rights in the Middle East and GCC, including patents, utility models, industrial designs, trade secrets, breach of confidentiality, and copyright.
Imad focuses on 3IP commercial transactions and works closely with our corporate teams in the frame of corporate commercial transactions such as joint venture transactions and mergers and acquisitions. Imad assists in negotiating and drafting technology transfer agreements, licensing and commercialization agreements, revenue sharing agreements, confidentiality agreements, research agreements, and R&D agreements and others.
Imad also assists in 3IP litigation and enforcement matters and works closely with our litigation teams in the frame of contentious matters. Imad assists in handling disputes pertaining to breach of confidentiality, IP ownership, patent infringement, industrial design infringement, copyright infringement and others. He supports in managing and handling complex litigation cases before the relevant Courts including developing strategies and choosing the best course of action against infringers, and preparing bilingual court memorandums in conjunction with our technical consultants and litigation team.
Prior to joining Al Tamimi, Imad was an associate with over 13 years of international and local experience in intellectual property and commercial law.
Recent Experience
- Advising multinational companies to set and implement the best strategies to protect their IP rights in the GCC, focusing on Saudi Arabia.
- Assisting in a patent infringement case in KSA;
- Assisting with patent statements in front of the Saudi Food & Drug Authority (SFDA);
- Drafting lawsuits and exchanging pleadings for IP litigation cases before the Saudi Courts.
- Providing legal advice and assistance to clients in the context of their assessment of the chances of recoverability of their IP rights in the Kingdom of Saudi Arabia.
- Drafting and reviewing various types of legal documents, including share purchase agreement, shareholders agreement, assignment of the IP rights agreement, franchising agreements and other types of commercial agreements), legal memoranda and opinions, corporate resolutions, memorandum of association.
- Representing clients in seminars, trainings and workshops.
- Negotiating and drafting contracts and agreements for films and series in the production and entertainment sector.
- Negotiating and drafting share purchase agreements and shareholders’ agreements.
- Incorporating and following up the day-to-day activities of more than 300 commercials and drafting their memoranda of association, minutes of their board and general assembly meetings, and board and general assembly resolutions.
- Litigation: handling more than 1,000 cases and drafting all their pleadings in civil, commercial, intellectual property, banking, insurance, bankruptcy, real estate, and labour laws and attending their pleadings and court hearings.
