Biography

Damian has close to a decade’s worth of experience in dispute resolution focused on international corporate and commercial litigation, and has advised clients on a number of complex and high-profile disputes in both court and arbitration. He also has a wealth of experience in corporate fraud and regulatory investigations, international arbitration, insolvency and business rescue related matters, and has provided litigation support in several forensic investigations

Prior to joining Al Tamimi, Damian was a partner in the dispute resolution team at Webber Wentzel -one of Africa’s leading law firms, which is in an alliance with Linklaters. Damian has also been recognised in the South African edition of The Best Lawyers.

Recent Experience

  • Private investment company in proceedings relating to disputes arising from a suite of agreements concluded between the private investment company and several multinational investment corporations. The dispute related, among other things, to alleged breach of warranties, and the capitalisation of certain costs in annual financial statements.
  • Multibillion-dollar fund in proceedings aimed at enforcing various securities provided in respect of funds lent and advanced by the fund to a third-party project company.
  • International conglomerate in proceedings which culminated his client receiving payment in the amount of USD 100 million as part of a settlement agreement.
  • Global asset management company in proceedings relating to damages arising from the alleged unlawful termination of an agreement in terms of which financial fund administrative services were to be provided.
  • International bank in respect of a colossal fraud perpetrated on the bank. The fraud was committed by a faction of the bank’s top-level management.  This resulted in the capture of the bank, from which hundreds of millions of Dollars were siphoned from the bank to various entities.
  • International audit firm in relation to an investigation into alleged fraudulent reporting and manipulation of financial information.
