Al Tamimi & Company confirm participation in the UAE – Korea Economic Partnership Forum

Al Tamimi & Company, has confirmed its participation at the third UAE – Korea Economic Partnership Forum which will be held in Seoul from 27-28 May, 2013.

The forum is being held under the patronage of HH Sheikh Mohammed Bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE and Ruler of Dubai and has the full support of the Ministry of Foreign Affairs, the Ministry of Economy, the Federation of UAE Chambers of Commerce and Industry, the Department of Economic Development and the Dubai FDI.

Al Tamimi & Company will be the only law firm from the UAE exhibiting at the forum which will aim to further develop the economic partnership the UAE has with South Korea.

Mr Husam Hourani, Managing Partner is delighted that the firm is joining with the Government to promote the investment opportunities between the two countries.

Hourani stated, “Over the past two years, we have seen more and more Korean companies seeking to do business in the Middle East. We have worked with a number of high profile Korean companies and assisted them to set-up in the region according to their business model and strategy and with their ongoing business and operations.

“Doing business in any country outside of your own can be challenging and as a full service law firm, we are perfectly positioned to advise clients from the outset with regards to their corporate structure and then we are there to assist them with the ongoing development of their business.”

“The number of companies we are assisting in setting up in the UAE is an indication of the positive business environment that the UAE and the other countries in the Middle East are providing to companies seeking to do business in the region” he added.

The forum will include a trade exhibition that will feature meetings and discussions between businessmen and major Korean companies in addition to a number of investors. The exhibition is expected to attract companies from different sectors including IT, Manufacturing, Tourism, Healthcare, Power, Finance, Aviation, Construction and Real Estate

Appointment of Chris Appleby as the new Regional Head of Technology, Media & Telecommunications

April saw the appointment of Chris Appleby as the new Regional Head of Technology, Media & Telecommunications at Al Tamimi & Company. Based in the Dubai office, Chris is a welcome addition to the team where he brings experience in a wide variety of transactions in a number of jurisdictions including Dubai, Qatar, Australia, Hong Kong and New Zealand.

Chris qualified as a solicitor in Christchurch, New Zealand in 1991, and advises on information technology, telecommunications law and regulation, large-scale IT/telecoms infrastructure procurement, outsourcing, intellectual property and competitive tendering and contracting. Chris has experience in both private sector and government Technology, Media & Telecommunications work and has spent time on secondment as Senior Counsel at Vodafone Qatar and Dell Services in Qatar.

Prior to joining Al Tamimi Chris headed up a Qatar based law firm’s Technology, Media, Telecommunications and Intellectual Property practice. Chris also previously a partner and Head of TMT Middle East in the Dubai office of the international law firm SNR Denton.

AL TAMIMI & COMPANY HOST TWO BREAKFAST SEMINARS ON QATAR'S NEW COMPANIES LAW AND UPDATED BANKING LAW

On Wednesday 17 April and Tuesday 23 April Al Tamimi & Company hosted breakfast seminars on Qatar’s New Companies Law and Updated Banking Law.

The seminars examined the new Companies Law which has introduced new concepts and principles aiming to shape the way entities operate in Qatar, encourage investment and provide comfort to investors and organisations looking to expand their operations in the State. The seminars also gave an overview of the new law governing the central Bank of Qatar and the banking industry in the State and provided a useful gap analysis of the changes and clarified the impact.

PARTNER AND REGIONAL HEAD OF CORPORATE STRUCTURING ADDRESS LAW STUDENTS FROM THE UNITED STATES

Partner and Head of Corporate Structuring Practice, Samer Qudah, presented to 16 law students from the USA at the Dubai Judicial Institute on 24th March 2013. The subject of his presentation centred on the “Legal Formula to Operate in the UAE”. It is interesting that a lot of western educated law students are looking into practicing in the UAE and Samer is someone who does not stray away from Social Responsibility and giving the youth a chance to compare jurisdictions and differentiate practice areas.

Samer’s presentation was both comprehensive and insightful, and gave all of the attendees an excellent insight into how one sets up a business in the UAE.

ANTI-ILLICIT TRADE ENGAGEMENT CONFERENCE – DUBAI

The conference was aimed at helping key stakeholders across the region to tackle the issue of illicit trade by sharing information, best practices and experiences.

The conference was attended by key stakeholders from across the region and over the two days issues discussed included combating illicit trade, the impact of illicit trade on taxes and country specific experiences including from Egypt, Iran, Iraq, Jordan, Lebanon, Morocco and Turkey.

Omar Obeidat, Partner and Head of the Intellectual Property Department of Al Tamimi & Company, presented at the conference as a member of the Board of the Brand Protection Group GCC & Yemen (the “BPG”), sharing the BPG’s experiences and learning in the GCC region. Omar is a key advisor to global and regional clients on anti-counterfeiting matters and have been instrumental to clients in devising effective anti-counterfeiting strategies and executing those strategies in order to protect valuable trade mark assets.

AL TAMIMI & COMPANY SPONSORED LCIA ARAB LAW USER’S SYMPOSIUM – 21 MARCH 2013, DOHA

The one-day symposium was co-hosted by the LCIA Arab Users' Council and the DIFC-LCIA Arbitration Centre and was supported by the Qatar International Court & Dispute Resolution Centre and the Qatar International Arbitration Centre.

Essam Al Tamimi, in his position as ex-President of the LCIA Arab Users’ Council, opened the conference with a welcome speech. Panels of eminent and experienced international arbitration practitioners then gave brief presentations on some of the most important areas of international arbitration, critical to establishing and maintaining an arbitration-friendly environment. Following the presentations, delegates participated in free-flowing discussions on the issues raised and debated topics of their own.

The symposium was attended by arbitrators, in-house counsel, practitioners, academics and members of the local and international business community interested in, and affected by, current developments and best practice in the field of international arbitration.

Hassan Arab, Hani Al-Naddaf and Mohammed Al-Marri from Al Tamimi & Company also attended and participated in the symposium.

BAN ON CIGARETTES SALES IN SHARJAH!

Whilst the implementation of this decision is yet to be cleared, the decision will mainly limit the sales in residential areas and markets that are close to schools.

The written decision has not been publicly circulated yet but the officials and some local releases confirmed that decision will impact grocery stores in certain districts. It was implied that cigarettes can continue to be sold as usual in the Emirate at the shopping malls, mini-markets at petrol stations, big stores, hypermarkets, shops at commercial zones, industrial districts and grocery stores, as long as they are not located near schools or certain residential areas.No announcements have been made about how inspections and market compliance will be carried out. It is anticipated that the Sharjah Economic Department will also be involved to ensure compliance at the points of sales.

It is expected that officials at Sharjah Council passed this decision to adhere with World Health Organization and national policies in the UAE adopted for anti-tobacco and mainly to ensure that cigarettes are not made available for sale to children and unaccompanied minors.

A CLOSER LOOK AT THE COSTS OF ARBITRATION

On 28 March 2013, expert lawyers from our Arbitration team held a legal seminar in Dubai. Paul Turner, Al Tamimi & Company’s Regional Head of Arbitration spoke on the costs of arbitration, ways of pricing cases and the different ways of saving costs.

Senior Associate Robert Karrar-Lewsley shed light on identifying the types of costs that can be claimed and the process of claiming them. Senior Associate Fiona Campbell focused on ways to keep costs down in Arbitration and Associate Jessika Stadwick identified the various categories of cost including tribunal, administrative and legal fees. The seminar was attended by a number of banking and government officials from the region.
