Malaysian Master Builders Association Malaysia (MBAM) is an important player in the development and advancement of the Malaysian construction industry. Its members are leading construction companies which represent the voice of the Malaysian construction industry. Many of these companies have been actively undertaking projects in the Middle East. Last year the Malaysian National News Agency reported that Malaysian contractors were working on 51 projects worth USD10bn in the Middle East.
At the invitation of MBAM, Eric Teo, Senior Associate from our Construction & Engineering practice gave a talk to members of the association in Kuala Lumpur on 15 September 2011. The talk was aimed at introducing UAE construction law and the practice of civil law in the UAE in comparison with common law practice in Malaysia.
Given the depressed construction market in the UAE, there were queries and interests relating to contractors’ rights and liabilities in the event of disagreements and disputes amongst the parties. To address the queries, Eric highlighted a number of issues and precautions that contractors should be aware of and shared the types of interim and final remedies that are available to the aggrieved parties under UAE law.
