Senior Associate Nick O’Connell recently hosted round-table discussions on ‘Technology Contracting: Best Practices'. The sessions, which were held in both Dubai and Abu Dhabi, were of particular relevance to procurement specialists and in-house legal counsel, and attracted considerable interest from both technology purchasers and technology vendors. Topics discussed included common types of IT agreements, government procurement rules in an IT context, and limitations of liability under local law. There was lively discussion regarding reporting and escalation mechanisms, practicalities of change control provisions, termination under local law, and governing law and dispute resolution considerations. Participants valued the opportunity to exchange ideas with others in the industry who are typically 'on the other side' of the negotiating table, and input of Al Tamimi's litigation and arbitration specialists provided further valuable depth to the discussions.
